In relation to the information that has been circulated by media outlets regarding our collaboration agreement with the National Institute of Fine Arts and Literature (INBAL) and the private collectors who own the collection, we issue the following clarification:
Fundación Banco Santander, driven by the desire to promote the Gelman Santander Collection internationally, will at all times comply with Mexican law, specifically the Federal Law on Archaeological, Artistic, and Historic Monuments and Zones and its Regulations, as well as the Customs Law, in all matters relating to the conservation and exhibition of the artworks and artistic monuments of the Gelman Santander Collection, all in coordination with INBAL.
The agreement entails five years of collaboration with the current administration, a term that corresponds to an institutional framework for coordinated work, which will in no way contravene Mexican legislation regarding the care and supervision of the works included in the collection, especially those that have special protection due to their designation as artistic monuments, with their return to Mexico in 2028 already foreseen.
It is an honor and a great satisfaction for Fundación Banco Santander to present the collection with great success at the Museum of Modern Art in Mexico before showcasing it in Santander this coming autumn. We hope that audiences in other parts of the world will subsequently also have the opportunity to experience these works from one of the most important periods of modern Mexican art.
We reiterate that no agreement entered into provides for a change of ownership or the permanent relocation of the collection to any location outside Mexico, as has been explicitly stated on multiple occasions by the Mexican authorities, the collectors, and Fundación Banco Santander.
